South Africa: Proposed amendments to the market inquiry provisions of the Competition Act, 89 of 1998 (the Act) as set out in the Competition Amendment Bill, 2018

A “market inquiry” is a formal inquiry in respect of the general state of competition in a market for particular goods or services.

In the circumstances, the reasons for the proposed changes appear misdirected and there are no apparent grounds.

Now that the new FIDIC suite of contracts has been in circulation for a few months, industry players are starting to look at the bolts.

A clear focus of the Bill is to address two persistent structural constraints on the South African economy.

This article sets out some perspectives on the proposed amendments to section 8 of the Act.

The Competition Amendment Bill was introduced in Parliament by the Minister of Economic Development on 11 July 2018, and was duly published.
