Partner, Richard Bryce, joined Michael Avery on Fine Music Radio for a conversation on a recent Competition Appeal Court judgment: the Court upheld an appeal by Pepkor Holdings Ltd and Shoprite Holdings Ltd and set aside the Competition Tribunal’s order that had granted Lewis Stores (Pty) Ltd wide-ranging rights of intervention in the Tribunal’s hearing of the large merger involving Pepkor’s proposed acquisition of Shoprite’s furniture business. The judgment provides important guidance on the appropriate limits to third party intervention in merger proceedings under the Competition Act, 89 of 1998, as amended.Â
