On Wednesday, 01 September 2021, we hosted a webinar on the impact of the South African Competition Act on the future participation of historically disadvantaged individuals in transactions.
The session focused on this issue in general and whether properly construed, the Commission’s decision in ECP/Burger King sets the standard for assessment of the public interest in proposed transactions.
The discussion was moderated by Xolani Nyali, partner in our Competition Practice. Panel members included Lebohang Mabidikane, also a partner in our Competition Practice, Kganki Matabane, chief executive officer and executive director of the Black Business Council as well as Shawn Flatt, minister counsellor for economic affairs, United States Embassy.
