Overview

Claudia Jackson is a partner in the Dispute Resolution Department of our Johannesburg office, and a member of the Shipping, Aviation and Logistics practice. She has extensive experience working in top-tier international law firms and helping clients in the insurance and aviation sectors in the South African, African and off-shore jurisdictions.

Most of Claudia’s practice involves complex, multijurisdictional insurance related disputes with a particular focus on financial lines, catastrophe and aviation insurance.   In those sectors, advises insurers, reinsurers and corporate insureds.  Claudia’s practice also includes general commercial disputes in the insurance and aviation sectors.

The majority of Claudia’s instructions emanate from the Lloyds and South African aviation insurance markets. These include coverage advice, subrogated recoveries and defences and regulatory advice and product development. 

She is an exceptional technical and tactical lawyer, with a proven track record in managing teams and projects. Claudia is a very proactive lawyer, partnering with her clients to provide responsive, practical and pragmatic advice.

Experience

Insurance and Reinsurance

  • Representing insurers based in Namibia in relation to potential fraud committed by an employee giving rise to multi-party litigation in Namibia and disputes with its reinsurers based in South Africa and internationally.
  • Representing reinsurers based in England and India in relation to a claim under a facultative reinsurance treaty arising from a claim in Tanzania. The matter included extensive consultation with the Tanzanian insurance regulator, and management of conflicts of laws between the policies and various jurisdictions.
  • Representing the insured and reinsured located in Botswana, and its internationally based reinsurers, in relation to a loss in Botswana. The matter included litigation in Botswana, France and England. 
  • Representing reinsurers and the reinsured in relation to a loss arising in Tanzania. The matter involved novel issues in Tanzanian law including the merger of state-owned entities and common, conflicting interests under the relevant policies.
  • Representing reinsurers and insurers based in England, in respect of a fraudulent claim by a South African insured. The claim was successfully rejected.
  • Representing reinsurers and insurers based in England and India in relation to a series of fraudulent claims brought by common South African and other insureds under multiple policies. The claims were successfully rejected.
  • Representing South African insurers, reinsurers and intermediaries on the changing insurance regulatory regime.

Aviation

  • Representing South African and international insurers and reinsurers on coverage and subrogated recoveries/defences arising from multi-jurisdictional and cross-border claims within Africa.
  • Advising on claims in relation to improper maintenance by aircraft maintenance organisations in South Africa and other jurisdictions.
  • Advising on claims in relation to product defects by aircraft manufacturers and their agents in South Africa and other jurisdictions.
  • Advising local operators, aircraft maintenance organisations and other stakeholders in the aviation sector in relation to their commercial disputes and regulatory compliance.
  • Representing the Civil Aviation Authority of South Africa and its insures and reinsurers in respect of a fatal accident resulting in the death of three employees.

Other Experience

  • Representing large multinational companies in restructurings and/or insolvency proceedings, including C&J Energy (concluded), Brunswick Rail and Seadrill.
  • Advising boards of directors and senior management in relation to officers’ duties and AML/ATF regulatory compliance, including Crown Global, Credit Suisse, Clarien Bank and Bermuda Commercial Bank.
  • Representing the Bermuda Monetary Authority and the Regulatory Authority in enforcement actions against regulated entities.
