Busisiwe Nhlapo advises domestic and multinational corporate clients who are mainly in the mining and financial services sectors, professional services firms and public bodies on a wide range of commercial, regulatory, administrative and dispute‑related matters.

Her experience spans large‑scale commercial disputes, judicial review proceedings, corporate investigations, public procurement challenges, anti‑corruption advisory work, class actions, energy‑sector regulation, arbitration and regulatory compliance issues, particularly those relating to public procurement and associated legislation.

Busisiwe has significant experience advising on high‑value commercial disputes, strategic infrastructure, renewable‑energy projects, electricity‑trading regulation, PPP frameworks and financial regulatory enforcement across the mining, financial services and energy sectors.

Busisiwe has broad experience in dispute resolution and risk advisory including involvement in major corporate and white collar crime investigations, business ethics and anti-corruption matters, and regulatory risk management. She routinely assists clients in navigating legally complex and reputationally sensitive matters, often requiring multi‑disciplinary coordination and strategic engagement with regulators and key stakeholders.

  • A listed entity in urgently reviewing and setting aside a Ruling and compliance notice issued by the Takeover Regulation Panel pursuant to a general offer to shareholders and proposed delisting of the entity;
  • the Prudential Authority in applications before the Financial Services Tribunal, for the reconsideration of the regulator’s decision/s to refuse a variation of licence application by an insurer and impose certain licence conditions;*
  • a multinational producer of smart meters, in arbitration proceedings emanating from a contractual dispute with a local supplier;
  • The South African Reserve Bank in judicial review proceedings related to a forfeiture to the State pursuant to contraventions of the Exchange Control Regulations by the applicant;*
  • a consortium in the mining industry regarding a dispute related to its unsuccessful bid in a public procurement (tender) process;*
  • A leading international energy company on the legal framework regulating transmission projects in South Africa;*
  • a former CFO of a listed South African entity, who is facing criminal and civil charges as well as regulatory investigations for alleged misstatements of financial results and breaches of fiduciary duties;*
  • the Prudential Authority on its roles and responsibility in respect of the liquidation of an insurer;*
  • a major South African bank in civil proceedings instituted in South Africa and in the UK arising from its position as custodian of a failed collective investment scheme;*
