Overview
Aliyah Ince is an Associate in our Dispute Resolution Department specializing in public law and regulatory matters.
Aliyah has wide-ranging experience in administrative and constitutional law matters and advises clients in both the public and private sectors in, amongst others, the energy, mining, public procurement, infrastructure, environmental and logistics sectors.
She also has experience in litigations, investigations, government contracting, opinion work and broad-based black economic empowerment matters within a public law and regulatory context.
Experience
- Advising various state-owned entities, including Eskom, in relation to challenges to public procurement processes, including bringing and defending judicial review proceedings.
- Advising various state-owned entities on the application of the Preferential Procurement Policy Framework Act to their operations.
- Investigating past corruption at Eskom and assisting Eskom with litigation proceedings and the Zondo Commission into State Capture.
- Advising international and local clients on various government tender processes.
- Conducting due diligence exercises in respect of environmental and other regulatory compliance issues in a range of sectors including mining, industrial, commercial property, and linear developments.
- Advising the state party, National Treasury, lenders, sponsors and/or concessionaires on the regulatory and procurement aspects of public private partnerships, including the Gautrain Project.
- Acting for a rolling stock and rail transport manufacturer in a complex High Court judicial review application.
- Acting in a regulatory capacity for various World Bank infrastructure projects.
- Advised the global operator of a floating power plant fleet on regulatory compliance aspects in relation to a South African powership project.
- Dispute resolution proceedings in the construction and infrastructure sectors, particularly litigations, arbitrations, and adjudications.

- BA Law degree and an LLB degree from the University of the Witwatersrand.
