South Africa: Amendments to the Employment Equity Act (EEA)

The amendments to the EEA came into force on 1 August 2014. An important addition was section 6(4), which now expressly sets out the right to equal treatment for employees who perform the same or similar work, or work of equal value. An employer may not provide different terms and conditions of employment to employees performing the same or similar work, or work of equal value, by differentiating on any of the prohibited grounds. These include race, gender, age, religion or any other arbitrary ground.
