The Competition Commission’s investigation into exclusive lease agreements entered into between supermarkets and property developers, owners and managers of shopping malls, has ended. The Commission concluded that although such agreements may raise barriers to entry in grocery retailing, there is insufficient evidence to meet the tests for demonstrating anti-competitive behaviour as set out in the Competition Act no 89 of 1998 (“the Act”).
