PARLIAMENT EXTENDS THE PERIOD FOR CONSIDERATION AND APPROVAL OF LAND REGULATIONS AND WILDLIFE CONSERVATION MANAGEMENT REGULATIONS BY 6 MONTHS
On 14 February 2018, a motion was moved and passed by Parliament that saw the period for consideration of various regulations that were before the Committee on Delegated Legislation, extended for a further 90 days from 14 February 2018.
These land regulations include:
- The Land (Extension and Renewal of Leases) Rules, 2017;
- The Land (Conversion of Land) Rules, 2017;
- The Land (Assessment of Just Compensation) Rules, 2017;
- The Land (Allocation of Public Land) Regulation, 2017;
- The Land Registration (General) Regulations, 2017;
- The Land Registration (Registration Units) Order, 2017;
- The Land Regulations, 2017;
- The Community Land Regulations, 2017; and
- The National Land Commission (Investigation of Historical Injustices) Regulations, 2017
Other regulations that were affected by the 90-day extension include regulations on Wildlife Conservation and Management, being:
- The Wildlife Conservation Management (Implementation of Treaties) Regulations, 2017;
- The Wildlife Conservation Management (Protection of Endangered and Threatened Ecosystems, Habitats and Species) Regulations, 2017;
- The Wildlife Conservation Management (Joint Management and Protection of Water Towers) Regulations, 2017;
- The Wildlife Conservation Management (Compensation) Regulations, 2017; and
- The Wildlife Conservation Management (Government Trophies) Regulations,
The regulations were submitted to Parliament for approval between 25 September 2017 and 13 December 2017, before the Committee on Delegated Legislation had been constituted, following the general elections held in Kenya, in the last half of 2017.
This additional 90-day period is well within the 6 month extension period from 31 January 2018 that the High Court granted to enable Parliament approve the Land Regulations relating to forms of title deeds.
The new Land Regulations and the Wildlife Conservation Management Regulations are therefore expected to be approved in full or with modifications, by no later than Monday 14th May 2018.
