RECENT UPDATES ON MERGER NOTIFICATION PROCESS IN KENYA
The Competition Authority of Kenya (the “CAK”) has recently announced that, with effect from 1 July 2014, it intends to impose filing fees for all mergers notified to it in accordance with the provisions of the Competition Act (Cap 504). Section 78(3) of the Competition Act gives the CAK the power to prescribe filing fees to be paid by persons in connection with the procedures of the CAK under the Competition Act. Although Kenya has had an antitrust legislation in place since 1989, this will be the first time in Kenya’s history that merger filing fees are payable.
