Coulson Harney (CH) successfully advised and defended Sony Corporation in the Court of Appeal in a decision which settled the issue of whether the Registrar has discretion to extend time for the filing of a notice of opposition in trademark opposition proceedings. In a unanimous decision, the Court of Appeal agreed with the High Court that had upheld the decision of the Registrar in extending time to allow Sony Corporation file its oppositions to two trademarks filed by Sony Holdings, a local Kenyan company. The Court of Appeal stated that the extension of time is an exercise of discretion for which the court would not interfere in line with Rule 82 of the Kenyan Trademark rules.
